An “Unprecedented” Error
The legal battle took an unexpected turn when the defense of the Gambling Commission mistakenly disclosed thousands of documents, some of which were confidential, to the claimants. This error has prompted the claimants to seek an amendment to their legal challenge, pending court approval.
Hogan Lovells, the legal representation for the Gambling Commission, admitted to making an “unprecedented” mistake during the disclosure of pre-trial documents. The released documents, totaling 4,321, included sensitive and confidential data related to the Fourth National Lottery contract.
During a recent hearing, Northern & Shell requested permission to use some of the disclosed documents in their claim over the National Lottery license. While parts of the hearing were closed to the public, a decision from the court is expected soon.
Defendants Claim Unfair Advantage
On behalf of the Commission, Tamara Oppenheimer KC stated that the disclosure of privileged documents was an “obvious mistake” and should not be exploited by the claimants for an unfair advantage. However, Sa’ad Hossain KC, representing the claimants, expressed their intention to use the documents and amend their plea.
The court will ultimately decide whether the additional documents can be used in the trial, with no guarantee of a favorable outcome for the claimants.
